Wonderware Trademark Usage Policy

Trademarks are proper terms that identify the products and services of a business and distinguish them from products and services of others. Proper use of trademarks is important because if the mark is used improperly, it can end up as a generic name of the product or service thereby losing its distinguishing function. When a trademark becomes generic, it loses value because anyone may use it.

Reservation of Rights

Invensys is the owner of all right, title and interest in Wonderware trademarks ("Wonderware Marks") and Wonderware logos. No person or entity may reproduce or use (or authorize the reproduction or use of) the Wonderware Marks or Wonderware logos in any manner other than expressly authorized by Wonderware. Unauthorized use of Wonderware Marks or Wonderware logos is strictly prohibited.

Always Use Wonderware Marks As Proper Adjectives

A trademark is an adjective and should not be used as a verb or noun or in the possessive or plural forms. Every Wonderware Mark should be followed by a generic term. As a minimum requirement, use the generic term after the trademark at least once in each written communication and, when appropriate, in broadcast matter - preferably the first time the mark appears.

Examples:

Kodak® cameras
Vaseline® petroleum jelly
FactorySuite® industrial software application

Do Not Alter Wonderware Marks

When using a Wonderware Mark, never vary the spelling, add or delete hyphens, make one word two, or use a possessive or plural form of the mark.

Do not abbreviate a Wonderware Mark to create an acronym. Examples of incorrect use:

FS instead of FactorySuite®
DTA instead of DT Analyst™

Use the Correct Symbol

When using a Wonderware Mark in text form use the correct ® or ™ symbol, as indicated on the trademark listing below ("Trademark Listing"), on the most prominent (or if none is prominent, the first) occurrence of the trademark. Once a Wonderware trademark is correctly attributed on a document or web page, it is not ordinarily necessary to mark subsequent appearances of the trademark within the correspondence.

Use Footnotes for Correct Attribution

It is Wonderware's policy to attribute Wonderware Marks in a footnote as follows. If other company products have been referred to in the correspondence, the additional language set forth in brackets is also required:

Example:

"__________ is a trademark of Invensys plc, its subsidiaries and affiliates. [All other brands may be trademarks of their respective owners.]

Note: The blank space should be a list of all Wonderware Marks that appear in that particular piece. The brackets themselves should not be included.

Third Party Trademarks

Some Wonderware products include technology used under license from third party licensors. You may not use any such third party trademarks without express permission from the owner.

Do not use another company's trademark to show endorsement, approval or an association with that company without its written approval.

Trademark Listing

The Trademark Listing below reflects registration status in the United States. Please note that it is not permissible and actually illegal to use the ® symbol unless the mark is registered in the appropriate national Patent and Trademark Office. For the correct trademark symbol usage in other countries, please contact the Legal Department.

Please refer to the Wonderware Trademark Listing periodically to ensure your compliance.
